PRIVACY POLICY

Powerhouse is a trading division of Jersey Electricity plc (JE) comprising the Powerhose.je Jersey based website and two retail stores. Both sell a wide range of electrical goods, other products and services. Powerhouse is committed to ensuring your privacy is protected. This privacy notice applies to Powerhouse in respect of personal data controlled or processed by Powerhouse.

Powerhouse complies with the Data Protection (Jersey) Law 2018 (DPJL) relating to personal information you supply to the Powerhouse.je website or to us in our retail stores. The website and our other systems use a security system that protects your information from unauthorised use. However, as no data transmissions over the Internet can be guaranteed to be 100% secure, we cannot ensure or warrant the security of any information you transmit to us over the internet and you do so at your own risk.

Who we are

By ‘we’, ‘us’, ‘our’ we mean Powerhouse, PO Box 45, The Powerhouse, Queens Road, St Helier, Jersey. JE4 8NY. By ‘you’, ‘your’ we mean any individual client, supplier or other third party that receives products or services from us, uses our website or otherwise interacts with us.

The information we collect

    1. We need to collect certain personal data and other information from you in order for you to receive products and/or services from us. We collect this personal data when you communicate with us by any method, via our website or social media. The personal data we collect is:
    2. Your title, name and address, for billing and delivery purposes;
    3. Your other contact details e.g. your telephone number and email address;
    4. Your date of birth;
    5. We will allocate you an account number;
    6. Financial information e.g. your bank account and debit or credit card information which you choose to provide to us;
    7. Your payment history;
    8. Your consent;
    9. Your preferences in so far as these relate to Powerhouse.je;
    10. If you visit our retail stores we may record your image on our CCTV systems. We do this for reasons of security to protect our staff, customers, premises and other assets;
    11. If you visit our website we collect your IP address, details of the browser software you are using and we record what you do on our websites. We do this using “cookies”:

 

    1. You should be aware that information and data may be automatically collected through the use of cookies;
    2. Cookies are small text files a website can use to recognise repeat users and allow us to observe behaviour and compile aggregate data in order to improve our website and to target its advertising;

  1. If you use our in-store wifi, we collect Location Based Services (LBS) data about you. Please refer to section 3 a xi below for more information about this and how we use this information;
  2. If you use social media to communicate or connect with Powerhouse then we collect certain personal data from your social media profile e.g. your name and we may store your social media profile which we may combine with other personal data we hold about you

What we do with your personal data

  1. The purposes for which personal and special category data are intended to be processed:
    1. Enable you to access all areas of our website and to place orders for goods, services and other products from us;
    2. Respond to your questions;
    3. Identify you;
    4. Contact you to provide information about our services, changes thereto and other administrative matters we may wish to bring to your attention and, with your consent, details about new products, services and offers that may be available to you from time to time;
    5. Staff training;
    6. Product development;
    7. Market research;
    8. Ensure your health and safety and that of our staff, contractors, subcontractors and other third parties who may be involved in the provision of goods, services and other products to you or other clients of Powerhouse;
    9. We use your payment history to help us offer you credit, where you request it;
    10. Manage and enhance our websites;
    11. We may use trusted third parties to carry out certain activities on our behalf and may share your personal data with them for the purposes of: processing and sorting data, monitoring how customers use our site, issuing our emails for us and collecting product/customer feedback from you via surveys. The third parties include Reevoo, Hamilton Brooke, Youreco this is by no means an exhaustive list but it gives an indication of the many third parties we work with.

Our in-store wifi provider, Purple, provides us with LBS data, which we use to understand traffic patterns in our Queens Road store, such as how long customers stand in line and how they generally move around an area, enhancing operational efficiency and improving our customers’ experience.     7. To enhance the functionality and security of our systems and to ensure these best meet the needs of our customers and visitors to our websites;
    8. To ensure Powerhouse meets all legal, regulatory and ethical obligations incumbent upon it;
    9. To safeguard the interests of our various stakeholders.

Consent

We may rely on your consent to process personal data in respect of certain direct marketing by post, email, text message or other means. You have the right to withdraw your consent at any time. Should you wish to withdraw your consent for either of these purposes then please contact us using the details at the end of this notice.

Who we pass your personal data to, if we pass this on to any third parties

  • Suppliers, contractors, subcontractors and other third parties concerned with the provision of goods and services;
  • Providers of other goods and/or services or in connection with the provision of our websites, technical support and security services;
  • Payment collection processors;
  • Delivery/logistics service providers;
  • Marketing and research agencies;
  • Companies that enable us to collect your reviews and comments.
  • We may use trusted third parties to carry out certain activities on our behalf and may share your personal data with them for the purposes of: processing and sorting data, monitoring how customers use our site, issuing our emails for us and collecting product/customer feedback from you via surveys.   • Credit reference agencies (only if you are applying for credit);
  • Auditors;
  • If our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners;
  • Flixmedia. Flixmedia partners with Powerhouse.je in order to provide you with official manufacturer’s information about the product you are considering and is not an advertising service. Powerhouse.je passes your IP address to Flixmedia, who process this solely to permit the delivery of the manufacturer’s video, image or text information but does not store your IP address as part of this service to us and does not provide your IP address to third parties other than technology partners who support information display. Flixmedia does not process or store any other piece of personal information about you nor obtain any other of your personal data from third parties.   • Any third party in connection with the enforcement of our terms and conditions or the collection of debts or for the protection of our rights or those of a third party, our staff, customers or others in connection with the protection of our assets or the safety of any person, the recovery of amounts due to us, to respond to any claims against us and to prevent illegal activity;
  • Government departments including, when required by law, the Police;
  • Regulators or other legally appointed organisations.

 

The period for which personal data will be stored.

The period for which personal data will be stored, or if that is not possible, the criteria used to determine that period:

Powerhouse will store your personal data for a period which is appropriate to the purpose for which it is collected and processed, including to meet any legal, accounting or other regulatory/reporting requirements. Our usual practice with regard to personal data held in respect of customers is to keep records regarding their identity and the operation of their account for 10 years from the date their account is settled. If you write to us we would routinely keep your correspondence, together with any reply and other relevant information, for 3 years from the date of the conclusion of the matter.

Data subjects’ rights

Data subjects have the following rights regarding data processing, and the data that is recorded about them:

  1. To make subject access requests regarding the category and nature of information held, the purpose for which it is held, details of any processing performed, the period for which it is to be held and to whom it has been disclosed;
  2. To prevent processing likely to cause damage or distress;
  3. To prevent processing for purposes of direct marketing;
  4. To be informed about the mechanics of automated decision-taking processes that will significantly affect them;
  5. To not have significant decisions that will affect them taken solely by automated processes;
  6. To sue for compensation if they suffer damage by any contravention of the DPJL;
  7. To take action to rectify, block, erase, including the right to be forgotten, or destroy inaccurate data;
  8. To have personal data provided to them in a structured, commonly used and machine-readable format, and the right to have that data transmitted to another controller;
  9. To object to any automated profiling that is occurring without consent. This is linked to the rights of the data subject to object to profiling and to be informed about the existence of profiling, of measures based on profiling and the envisaged effects of profiling on the individual;
  10. Data subjects have the right to complain to Powerhouse in respect of the processing of their personal data;
  11. To lodge a complaint with the relevant supervisory authority.

Automated decision-making

  1. Powerhouse uses personal data collected about you to help us offer you credit, where you request it;
  2. You have the right to object to any decision made wholly or partly by automated means. You can ask for an explanation of any automated decision. You can require a human review of any automated decision. Should you wish to exercise any of these rights please contact us using the details at the end of this notice.

Provision of personal data
